    In a 5 to 4 vote the Supreme Court of the US found in District of Columbia vs. Heller that the ban on ownership of handguns is unconstitutional.  Most importantly they ruled, for the first time in history, that the Second Amendment IS a right of the individual and not a collective or state right.
    I found it very intereseting that in the majority decision Justice Scalia gave all the gun-grabbers a lesson in grammer when he wrote:
    “The Second Amendment is naturally divided into two parts: its prefatory clause and its operative clause. The
    former does not limit the latter grammatically, but rather announces a purpose.  The Amendment could be rephrased,
    ‘Because a well regulated Militia is necessary to the security of a free State, the right of the people to keep and bear Arms shall not be infringed.’
    Logic demands that there be a link between the stated purpose and the command.”
    This is the death knell of the Brady Bunch’s arguement that the Second Amendment refers only to the States National Guard.

    Aestival Solstice

    The Aestival solstice is today June 20, 2008 at 1958 EDT tonight.  During the Aestival solstice the sun appears to be directly overhead at noon for places situated at latitude 23.44 north.  During the Aestival solstice places situated at latitude 66.56 north, the arctic circle, will see the sun just above the horizon at midnight, and all points north of it will see the sun above the horizon for all 24 hours.
    So to all you witches, pagans, warlocks, smelly hippies, whackos, neo-druids, phish fans and general wierdos the only thing special about this day is that today is the maximum inclination of earth’s rotational axis with respect to inertial space, thus the sun.

    The PA State Smoking Ban

    Well they did it.  Both the house and senate passed the smoking ban.  It could have been much worse.    The ban on smoking disallows smoking in any public place such as an office, a store or a restaurant.  The exceptions are; taverns where 20% or less of it’s sales are from food, private clubs, cigar bars and tobbaconists.  Of course they left in the exemption for Philadelphia.  Commandant Rendell wouldn’t have it any other way.  So once again we have two states here, Pennsylvania and Philadelphia.  I may be a big Phillies, Eagles and Flyers fan but that just aint right.
    Like I said above, it could have been much worse.  I was speaking with my friend Jim this afternoon and he told me that in Florida it is against the law to smoke in the parking lot of a restaurant.  Not actually in the restaurant but in the parking lot.  What kind of horse hockey is that?  Now I know there are a bunch of you no-smoking Stazi out there saying something like, ‘That’s not much of a ban’.  Well I say it is one I can live with.  I think it’s right that small bars, locals, are exempt from it and private clubs as well.   Also please explain to me why smoking should be banned from either a cigar store or a tobbaconist?
    Once it’s signed by the Governor it shall become law in 90 days and on that day I will head off to my local, which is a private club and have a smoke with my pint.


    Humidity

    The PA state smoking ban….maybe

    Both the House and the Senate of the state of Pennsylvania are today discussing the compromised bill on banning smoking.
    The bill states that smoking will be banned in all public buildings, restaurants,  offices and gub’mint buildings.  The exemptions are taverns with less than 20% food sales, private clubs, casinos except for the two casinos in Philadelphia.  There will be a non-preemption clause for Philly.
    In other words the law will apply to everywhere but Philly.  You see there are two things going on here.  First off Philly has for generations enacted laws contrary to the laws of the state.  They got away with it for years until Governor Tom Ridge, in the 1990’s, pushed through a preemption law.  This means that state law trumps local law and cities and towns cannot pass laws that go against state law.
    The case that caused this was the law covering the carrying of handguns.  The state passed a law expanding on this right and then promptly sued Philly for disallowing it and won.  Then Governor Ridge signed the preemption law.
    Secondly, our current governor, Commandant ‘Fast Eddy’ Rendell is a long time gangster from Philly so he continually tries to override any and all state laws in the favor of Philly creating their own laws.  He of course does not allow any other city or town to do this.
    I am listening to our Senate debate this issue while I write this (http://www.pasen.gov/Video/SenateVideo.cfm) and their main concern is that once again Philly gets to do what ever they want to while the rest of the state does not.
    If what I have been listening to is any indication then I’m happy in that it appears nothing will ever get accomplished.
    FLASH :  The Senate just voted 31 to 19 to reject the bill.  This is only the first vote and it will come up again next Monday.
    Now as far as I am concerned the whole thing is stupid.  I feel that the state should not have a right to tell a business if they can allow or disallow smoking.
